Terms & Conditions

August List is a curated discovery layer for exceptional stays. We are not a booking platform: reservations, payments, and stay contracts are concluded directly between you and the respective host or their booking channel. August List is not a party to those contracts.

Access to certain features requires an approved application and, for full access, a paid subscription. You must be at least 18 years old and legally able to enter into a binding contract. We may approve or decline applications at our discretion and may revoke access where the Terms are breached.

Each person may hold only one membership. Free-tier access is personal and non-transferable; attempts to circumvent free-tier limits by creating additional accounts are not permitted.

Paid memberships are billed on the plan you select (monthly on an annual commitment). A one-time Travel Pass is also available for a single trip. Prices are shown at checkout and include VAT where applicable. Subscriptions renew automatically until cancelled; you can cancel at any time via your account settings, and access remains until the end of the current billing period. The Travel Pass does not renew.

Right of withdrawal for consumers in the EU: You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day of contract conclusion. To exercise the right of withdrawal, inform us by a clear statement (e.g. an email to contact@augustlist.com). By starting to use paid membership features within the withdrawal period, you expressly consent to the immediate performance of the service and acknowledge that the right of withdrawal lapses upon full performance.

All content on the Platform — including listings, imagery, editorial, logos, and design — is owned by August List or its partners and is protected by copyright, trademark, and other intellectual property laws. You may not copy, distribute, scrape, or create derivative works without our prior written permission.

You retain ownership of content you submit (e.g. lists, reflections, submitted stays) and grant August List a non-exclusive, worldwide, royalty-free licence to host, display, and use such content to operate and promote the Platform.

You agree not to:

• Use the Platform unlawfully or in breach of these Terms.
• Misrepresent your identity or your affiliation with any person or entity.
• Upload harmful, infringing, discriminatory, or misleading content.
• Interfere with the Platform, other users, or its security features.
• Use automated tools to access, scrape, or copy the Platform without our written consent.

August List curates and displays stays but is not the operator of those stays. Availability, pricing, and booking conditions are set by the respective hosts. August List is not responsible for bookings, payments, cancellations, or disputes between members and hosts, and does not receive commissions on bookings.

To the extent permitted by law, August List is liable without limitation only in cases of intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act, and for breach of a guarantee.

In cases of slight negligence, we are liable only for the breach of a material contractual obligation (i.e. an obligation whose fulfilment is essential to the proper performance of the contract and on which you may routinely rely). In such cases, liability is limited to typical, foreseeable damages. Any further liability is excluded.

You may cancel your membership at any time. We may suspend or terminate your access if you breach these Terms, if your membership becomes inactive, or where required by law. Provisions that by their nature should survive termination (e.g. intellectual property, liability, governing law) will continue to apply.

We may update the Platform and these Terms from time to time. Material changes to the Terms will be communicated with reasonable notice. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Sales Convention (CISG). Mandatory consumer protection rules of your country of residence remain unaffected.

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
